Acceptance of Terms
By downloading, installing, or using the Minimums app ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.
These Terms constitute a legal agreement between you and Brandon Beals ("we," "us," or "our") governing your use of the App.
Description of Service
Minimums is an aviation weather application for iPhone that decodes METAR reports into plain English and provides a Go/No-Go assessment based on your personal weather minimums.
The App is designed for informational and educational purposes only. It is intended to help pilots understand aviation weather data, not to serve as a primary source of weather information for flight planning or operational decisions.
Disclaimer and No Warranty
Minimums is NOT a substitute for official weather briefings. You must always obtain a proper weather briefing from 1800wxbrief.com or another FAA-approved source before any flight. The App does not provide NOTAMs, TFRs, AIRMETs, SIGMETs, or other critical flight planning information.
The App is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We make no guarantee regarding the accuracy, completeness, reliability, or timeliness of any weather data, decoded information, or Go/No-Go assessments presented in the App. Weather data may be delayed, incomplete, or incorrect.
Limitation of Liability
To the fullest extent permitted by applicable law, Brandon Beals shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:
- Your use of or inability to use the App.
- Any errors, inaccuracies, or omissions in the weather data or decoded information.
- Any decisions made based on information provided by the App.
- Any unauthorized access to or alteration of your data.
- Any interruption or cessation of the App's functionality.
In no event shall our total liability exceed the amount you paid for the App.
Weather Data
The App retrieves weather data from aviationweather.gov, a publicly available API operated by the U.S. government. We do not control, operate, or maintain this data source.
We are not responsible for the accuracy, availability, or reliability of the data provided by aviationweather.gov. Data may be delayed, temporarily unavailable, or contain errors originating from the source. We do not independently verify weather observations before presenting them in the App.
User Responsibilities
As a user of this App, you acknowledge and agree that:
- You are solely responsible for your own go/no-go decisions. The App's Go/No-Go assessment is based on the personal minimums you configure and is intended as a reference tool only.
- You will always obtain a proper pre-flight weather briefing from an FAA-approved source before conducting any flight.
- You will not rely on the App as your sole source of weather information for flight planning or in-flight decision making.
- You are responsible for complying with all applicable aviation regulations, including 14 CFR Part 91 and any other relevant rules.
- You will exercise sound aeronautical decision-making at all times, regardless of what the App displays.
Intellectual Property
The App, including its design, code, features, and content, is the intellectual property of Brandon Beals and is protected by applicable copyright and intellectual property laws.
You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes in accordance with these Terms. You may not copy, modify, distribute, reverse engineer, or create derivative works based on the App.
Modifications to Terms
We reserve the right to modify these Terms at any time. Changes will be reflected by updating the "Last updated" date at the top of this page. Your continued use of the App after any modifications constitutes acceptance of the updated Terms.
We encourage you to review these Terms periodically. Material changes may also be communicated through the App or on our website at flyminimums.app.
Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law provisions. Any disputes arising from these Terms or your use of the App shall be resolved in the applicable courts.
